According to The Regulations of the State Council on the Work of Foreign Culture and Education Experts (October 1980), The Regulations of the Ministry of Education on the Employment of Foreign Scholars and Teachers in Higher Schools (document of Ministry of Education No. (1991) 462) and The Administration Methods of Foreign Professionals Employed in Schools and Other Educational Institutions issued by the State of Foreign Experts Administration and the State Education Commission (January 29, 1996), and, in order to manage foreign teachers well in Guangdong Baiyun University (abbreviated as the University), the following provisions are formulated.
Chapter One: General Principles
Article 1 The rules, regulations and measures concerning foreign experts' management stipulated by the State Council, Ministry of Education and the Foreign Experts Bureau shall be enforced strictly to manage our foreign teachers.
Article 2 The “foreign teachers” refer to 1) foreign experts (abbreviated as “foreign experts”) who are engaged in teaching and scientific research employed by the University, whose terms of employment are over 6 months (including 6 months); 2) professors (abbreviated as “visiting scholars”) who are invited by the University for academic exchanges and lectures, whose visiting time is within 1 month. Foreign experts have employment relationship with the University, whereas visiting scholars have no employment relationship with the University.
Article 3 The employment department refer to faculties / functional departments.
Article 4 Foreign teachers are managed by the University and faculties under the jurisdiction of the University executive where the Department of International Cooperation and Exchanges together with the Human Resource Department is responsible for appointment in accordance with the procedures and policies and the employment departments are responsible for daily management and services of foreign teachers.
Article 5 The Department of International Cooperation and Exchanges is responsible for formulating rules and regulations, dealing with the procedures for employment and and invitation of foreign teachers, issuing the border entry notifications, and coordinating daily administrative management and services of foreign experts and visiting scholars in collaboration with the employment departments.
Article 6 The employment departments should designate special persons to be responsible for managing foreign teachers’ teaching and scientific research as well as jointly arrange daily life of foreign teachers with the Department of International Cooperation and Exchanges.
Chapter Two: Employment Conditions for Foreign Teachers
Article 7 Terms and conditions of employment for foreign teachers are: 1) the foreign teachers must be good in character and health and be friendly to our country. 2) the foreign teachers engaged in language teaching should have a bachelor's degree or above and more than two years' teaching experience. Preference shall be given to those with high attainments in their native languages and literature, and those who have published in their professional fields. 3) the foreign teachers engaged in other disciplinary teaching should have a master's degree, more than five years of teaching and research experience, and have published academic papers in their professional fields.
Chapter Three: Application and Approval for Employment
Article 8 The employment department should confirm on the work plan or visit plan,formulate teaching contents and academic exchange contents (or programs), and assign persons to be involved in foreign teacher administrations of foreign teachers before they come to the University.
Article 9 The employment department should, in accordance with the needs of teaching and scientific research, submit to the Department of International Cooperation and Exchanges a written employment plan and application form for foreign teachers for the next year by the end of November or before the end of May every year.
Article 10 The Department of International Cooperation and Exchanges will, according to the employment criteria, make suggestions with Human Resources Department and the employment departments, which will be reported to the University Executive in-charge for review and approval.
Chapter Four: Management for Foreign Teachers
Article 11 The foreign teachers (except for visiting scholars) are the employees of the University. The employment department should introduce them on the Chinese guidelines, policies, laws and relevant rules, and regulations on education, and require them to comply with the relevant laws and regulations of China and the relevant rules and regulations of the University, to help them understand China and to be familiar with the teaching and scientific research in the department.
Article 12 The employment department should provide supporting teachers for foreign experts and visiting scholars, organize teachers and students to carry out teaching and academic exchanges and assessment, regularly check the performance of foreign teachers, and ensure the quality of foreign teachers' work.
Article 13 The employment department should strengthen the assessment on foreign teachers, and requires foreign teachers to report on their work by the end of the semester and by the end of academic year. The problems of foreign teachers should be discovered without delay and resolved in time. The DEpartment of International Cooperation and Exchanges is responsible for collating the reports of foreign teachers from every employing department, which should be used as a reference while renewing contracts with foreign teachers.
Chapter Five: Obligations of Foreign Teachers
Article 14 The foreign teachers should take an active part in teaching, research and related work of the University, who enjoy the rights and benefits stipulated in the employment contract according to the law.
Article 15 Foreign teachers must:
A) abide by the Chinese laws and regulations and do not interfere in China's internal affairs.
B) respect China's religious policy and not engage in activities that do not conform to the duties of a teacher.
C) respect the cultural traditions, ethics and customs of the Chinese people.
D) abide by China’s management regulations and requirements for the foreign expert visa.
E) abide by the University’ss Manual of Teachers and Working Staff and Code of Conduct of Foreign Teachers, and accept work assignments, guidance, inspection and evaluation, be not involved in other jobs than that are stipulated in the contract.
F) accept the assignmentst of the Dean of Faculty, perform the duties of teachers, and participate in teaching and scientific research activities.
G) not change teaching objectives, curricula, and timetables. No punishments in any form can be imposed on students.
H) earnestly write syllabus, carry out teaching plans and improve curriculum design.
I) abide by the teaching schedules, and allow no classes to start or be dismissed ahead of schedule. Foreign teachers should not allow for students’ leave or forbidden students from attending classes.
Article 16 The employment department is responsible for ensuring that foreign teachers perform the obligations stipulated in article 14 and article 15.
Chapter Six: Penalties
Article 17 The foreign teachers who have incurred liable accidents during the employment period should be dealt with according to “the Measures of Determining and Handling the Administrative Liable Accidents” and “the Measures of determining and handling the Teaching (or Managerial) Accidents” set in the Manual of Teachers and Working Staff.
Article 18 The University will take measures such as cancelling the contract, canceling expert visas and so on against the foreign teachers who have committed serious liable accidents.
Chapter Seven: Supplementary Provisions
Article 19 The Methods shall be implemented from the date of promulgation, of which the explanation authority shall rest with the Department of International Cooperation and Exchanges.
